These Terms of Service ("Terms") constitute a legally binding agreement between you and Sapelo AI Inc., a Delaware corporation operating as a foreign entity in Georgia ("Sapelo AI," "we," "us," or "our"). By accessing or using our website at sapeloai.com (the "Site") or any services we provide (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

• Cost of substitute services
• Personal injury or property damage
• Any damages arising from your use or inability to use our Services

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sapelo AI and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your violation of these Terms
• Your violation of any rights of another party
• Any content or information you submit through our Services

11. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause or notice, including if we believe you have violated these Terms. 12.3 Informal Resolution

Before filing any formal legal action, you agree to first contact us at hello@sapeloai.com to attempt to resolve the dispute informally. We will make a good faith effort to resolve any disputes through informal negotiation.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using our Services.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
